Quotes and consultations requested through the Website are provided on the basis of the information you give us. Quotes are valid for the period stated in the quote (or if none is stated, 30 days) and may change if your requirements, site conditions or supplier pricing change.
2.4 Separate Service Agreements
Supply of our products and services is subject to the specific terms in your quote, order form or service agreement, and may also be subject to the terms of our carrier, satellite network and technology partners. If there is any inconsistency between these Terms and a signed agreement with us, the signed agreement prevails in relation to those products and services.

- Informing your employees, contractors and drivers about any monitoring
You must not use our services to track or monitor any individual without their knowledge where the law requires notice or consent, or for any unlawful, harassing or stalking purpose.
5. Service Availability and Performance
Satellite, radio and wireless services depend on factors outside our control, including weather, atmospheric and solar conditions, terrain and obstructions, satellite orbits and coverage, carrier and network operator maintenance, and equipment installation and placement.
Accordingly, information on the Website about coverage, speed, latency, uptime and “reliability” figures is indicative only. We do not guarantee that any service will be uninterrupted, error-free or available in every location at all times, except to the extent expressly stated in a signed service agreement.
Our Website may also be unavailable from time to time due to maintenance, updates or technical issues. We may modify, suspend or withdraw any part of the Website at any time without notice.
6. Intellectual Property
All content on the Website, including text, graphics, logos, images, videos, brochures, articles, page layouts and software, is owned by or licensed to Hybrid Networks and is protected by Australian and international copyright, trade mark and other intellectual property laws.
Third-party names, logos and trade marks (including those of our technology partners) belong to their respective owners, and their appearance on the Website does not imply any transfer of rights.
You may view, print and download Website content for your own personal or internal business purposes, provided you do not modify it, remove any copyright or proprietary notices, or use it commercially or redistribute it without our prior written consent.
7. Information You Submit to Us
When you submit information through the Website, such as our contact form, you:
- Confirm the information is accurate and that you are entitled to provide it
- Grant us permission to use it to respond to your enquiry and to provide you with quotes and services
We handle personal information in accordance with our Privacy Policy.
8. Third-Party Websites and Content
The Website contains links to, and embeds content from, third parties, including our Tracking Portal platform, Google services, YouTube and our website developer. We do not control these third parties and are not responsible for their content, availability, accuracy or privacy practices. A link does not mean we endorse the third party. Your use of third-party sites is at your own risk and subject to their own terms.
9. Articles, Resources and General Information
Articles, brochures and other resources on the Website are provided for general information and do not constitute technical, legal, financial or other professional advice. You should obtain advice specific to your circumstances before relying on them. While we aim to keep information accurate and current, we do not warrant that it is complete, accurate or up to date.
10. Disclaimers and Australian Consumer Law
10.1 Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law, including under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law), that cannot lawfully be excluded or limited.
10.2 Website Provided “As Is”
Subject to section 10.1, the Website and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, that the Website will be uninterrupted, secure or free from errors, viruses or other harmful components.
11. Limitation of Liability
Subject to section 10.1 and to the maximum extent permitted by law:
- Hybrid Networks, its directors, employees and partners will not be liable for any indirect or consequential loss, loss of profit, loss of revenue, loss of data, loss of business or goodwill, or business interruption arising from your use of, or inability to use, the Website; and
- Our total liability to you in connection with the Website (as distinct from any products or services supplied under a separate agreement) is limited to, at our option, re-supplying the information or paying the cost of having it re-supplied.
Liability for products and services supplied to you is governed by your service agreement and applicable law. Where the Australian Consumer Law applies and permits us to limit our liability for a breach of a consumer guarantee, our liability is limited, at our option, to resupplying the goods or services or paying the cost of resupply or repair.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Hybrid Networks and its officers, employees and partners against any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Website or our services, or your breach of any law or third-party right, including in connection with tracking or monitoring individuals without proper notice or consent.
13. Suspension and Termination
We may suspend or restrict your access to the Website or any account, without notice, if we reasonably believe you have breached these Terms, are using the Website unlawfully or in a way that may harm us or others, or to protect the security of our systems. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a new “Last updated” date and apply from that date. Your continued use of the Website after changes are posted means you accept the updated Terms. Please review this page regularly.
15. General
Entire Agreement
These Terms, together with our Privacy Policy, form the entire agreement between you and us regarding use of the Website.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remainder will continue in full force.
No Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to a related entity or a successor to our business.
Force Majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, severe weather, solar activity, satellite or network failures, power or telecommunications outages, industrial action, cyber attacks or government action.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia, and courts competent to hear appeals from them.
